Judge Rules Phillip Garrido Is Competent To Stand Trial

 PLACERVILLE, Calif. (CBS13/AP) – An El Dorado County judge has declared Phillip Garrido mentally competent to stand trial for the kidnapping and rape of Jaycee Lee Dugard.

Lawyers for Phillip Garrido had argued that he is not mentally competent for trial, and a jury was set to hear arguments on the competency issue.

But both sides agreed instead to let El Dorado County Superior Court Judge Douglas Phimister decide the issue.

After the agreement was announced in court Thursday, Phimister quickly issued his ruling, based on numerous psychiatric reports.
Garrido and his wife Nancy are charged with kidnapping Dugard and holding her captive for 18 years.

Criminal proceedings against Phillip Garrido had been suspended until the issue of his sanity was settled.

They would be hard pressed to find a venue where the jurors won’t have had any exposure to information about the case. They might want to ask the Amish.

Actually, the attorneys are doing us all a justise by defending them, and it does not mean the believe they are not guilty of this crime in this particular case. It’s the only hope we have for innocent victims who are accused of crimes and believed to be guilty. I agree there is no place in this country that has not been made aware of this case, so just get on with it in my opinion, and get this costly trail over with. Obviously, without a need for a trail to determine Garrido’s mental state, by his actions alone, he is not right in the head. So start the trail. It should be quick . I also agree with Jaycee’s family that the details remain between them and the courts and not made public. Let’s all be thankful she’s home and hopefully recovering and we focus on what’s going on now instead of what has happened…It’s time to move on…
