Well…let’s recap…Second paragraph says “police found photos of a victim UNDER THREE engaging in sexual acts with an ADULT.” The man is an UNREGISTERED SEX OFFENDER. I dunno, call me strange but, I have never and would never take pictures of my child while bathing, kissing his/her chest and legs, and then send them to an inmate in prison??? WHY??!!! Given Scullys record as a headline grabbing prosecutor, such as in Isleton on the medical marijuana farm, , one wonders what is the truth. If he is a prior as alleged the police are probably correct but the truth is the police and prosecutors have gone after a lot of artist and families just to grab headlines and a year down the road the case is dismissed.

People with drug convictions are given MANDATORY time…So when there are two inmates convicted they must have room for the drug user/seller which means sex offenders and violent inmates are some times kicked out or paroled quicker.

Case in point I had a druggie porter who had almost no record except drug use doing 14 years on a nickle bag of meth…While there were known rapists getting out in about 3 years. Madness.

The Sacramento Police Department said they arrested two people after finding pornography depicting a victim under 3 years old engaging in a sexual act with an adult.

The male suspect, identified as Jose Martinez, was an unregistered sex offender and had been convicted of assaulting an ex-girlfriend, authorities said.

Correctional officers tipped off police after discovering the photos being sent to an inmate by mail, allowing investigators to trace the material back to the suspects’ Sacramento home, where they found more allegedly illicit pictures.

In a jailhouse interview, Martinez said the photos were innocent snapshots of his wife bathing their young child.

“We wife took a picture when I was playing with him,” Martinez said though a translator. “She was bathing him and I was kissing his chest and legs.”

Other photos showed Martinez tickling the boy, but none of the pictures had “bad intentions,” he said.

“That photo, they are looking at it in a different way than what I was thinking,” Martinez said. “I didn’t think I was doing anything inappropriate.”

Child protective services took two children under 3 years old into custody.

The male suspect is facing five felony charges, including creating child pornography and oral copulation with a minor.

It is easy for people to jump to conclusions with the given information. Media sources use key words to “shock” the public and sell stories, that is why media sources are banned from certain high profile cases. This story will definitely gain attention.

That aside, Just how do you know that this so called sex offender didn’t get honored with the title for peeing in public? This is just the issue with all of these laws. We will NEVER know how all these people got their honorary title of sex offender unless we were in court the day they presented evidence. So many now have that title simply by peeing in public, which is gross but not sexual, or having a walmart ad of a teen in a bikini. YES! It has pathetically happened. There are so many reasons why one can get these titles, yet so many are unreasonable.
Meanwhile it does not help the true victims or the real perpetrators get justice in our courts.
These laws need to be changed and fast. For the betterment of all..

this is a perfect example of people being falsely accused. it happens all the time. as a previous poster said, sex offender could be anything.. and while I personally know this family.. I know this mother and father did not so this to their children.. these poor kids were ripped away from their parents simply bc.the government has nothing better to do
