Lawsuit Claims Chuck E. Cheese’s Contains Illegal Gambling Machines

SAN DIEGO (CBS13) – A Southern California mother has filed a multi-million dollar lawsuit against Chuck E. Cheese’s franchise that she claims promotes gambling and puts children at risk for developing gambling addictions.

San Diego resident Denise Keller filed a class action lawsuit against CEC Entertainment, a company that owns Chuck E. Cheese’s family restaurants, alleging that many of the ticket-dispensing games found in restaurants are games of chance, not skill, and therefore are illegal under California’s anti-gambling laws.

The lawsuit seeks damages of “not less than” $5 million, according to court documents.

The civil action claims several popular games found in the restaurants are “based entirely or predominantly on chance or hazard,” with little chance of the player affecting the outcome.

“Thunderation consists of a vertical spinning wheel with numerous prongs protruding from it,” the lawsuit states. “The token then randomly bounces off of the spinning prongs until it is eventually dropped into one of the buckets at the bottom of the wheel.”

The plaintiff accuses the restaurants of operating slot machines and says “[y]oung people are especially vulnerable to the attractions of gambling.”

“The fact that the stakes are relatively low is of no consequence to a child,” the lawsuit adds.

Child psychologist Dr. Debra Moore greeted the claims with skepticism and said the accusations don’t appear to have much of a foundation.

“It feels like age-appropriate play, where kids are not even thinking about gambling,” Moore said. “They are having a wonderful time.”

Neither company residents nor the plaintiff’s attorney returned requests for comment Monday.

    I have a 2 year old niece. I don’t even need to give her tokens. She likes to go sit on the ski or horse and pretend she’s riding them.

    It’s a fun place where kids can have fun with other kids and their families. That lady is just looking for a reason to sue. I bet she was playing one of the games and got addicted!

    I grew up at Chuck E Cheese as my parents took me and my two sisters at least once a week when we were kids. Not one of us is a gambler, nor has any addiction to gambling. In fact, I hate gambling so much I will only play a maxium of five dollars ($5.00) if I even go to a casino which is once every ten years or so. And no, even losing a dollar to the lotto bugs me so I only play when the post exceeds 100 million. So please tell me where the addiction to gambling plays in to this ridiculous claim. Seems like another deadbeat looking for free money to me.

    It is unlawful for any person to make or to permit the making of an agreement with another person regarding any slot machine or device, by which the user of the slot machine or device, as a result of the element of hazard or chance or other unpredictable outcome, may become entitled to receive money, credit, allowance, or other thing of value or additional chance or right to use the slot machine or device, or to receive any check, slug, token, or memorandum entitling the holder to receive money, credit, allowance, or other thing of value.

    This is the classic “Frivolous Lawsuit” and should be treated as such. We passed a law to throw out such suits as this, as to not waist tax payers money so someone can try to win the lottery while the defendant goes broke defending stupidity.

    First thing is, to win a suit in the State you need to show you were wronged or damaged. This, she could not prove so the judge should throw it out under this Law and give the Attorney their first, of 3 marks to loose their right to practice law in the State.

    This state is broke and fine hard working folks are loosing their jobs because Company’s are constantly defending themselves against lame lawsuits and the money has to come from somewhere. The Attorneys who take cases like this need to be taught a lesson as well. The spending has got to stop. Not to mention all you fine folks with real cases that have to wait 6 months to be heard on good cases have to wait behind this muck.

    Yes, but that coffee at McD’s gave her 3rd degree burns over 50% of her body. At first all she wanted them to do was to cover medical costs, but the company refused. So she had to do the only thing that she could do: sue. She was found at fault but only 20% as she was driving while trying to put creamer in her coffee. Would you want 3rd degree burns on you because you coffee was so hot?

She would not get the proceeds of the suit, but Chuck E Cheese would have to pay out more than 5 million to the people in the class action (affected Californians).     I’m not saying that I agree that the games are damaging to children and I think its the parents responsibilities to teach your child to control their actions and not put too much of themselves into winning the games. Its more of an easy way to teach your child a lesson if you look at it that way. They have to learn to handle losing, how to stop when its time to stop, and just blah blah blah…I think you get my point or hope so anyways. If you take time to help your child learn to be in control of their choices then it shouldn’t be a problem for anyone but there are lazy parents out there that feel they shouldn’t have to make the effort. sad but true.

    If this woman actually wins this extemporaneous lawsuit then what will happen at all of the amusement parks in California? They will have to remove all of the games in the park where you: try to put a ball in a basket, try to land a ball on a milk bottle, use water to race to the finish, have somebody guess you weight or age, pop a balloon by shooting at it, etc.

    When will adults learn that kids do not think like them? Let the kids go to eat their pizza and have some fun.

    So … you think the government should impose fines and pass laws to make sure people aren’t exposed to certain activities? How is that not being a sheeple? As far as I can tell by most commenters here, they are using common sense. If they feel CEC is not for THEIR CHILDREN then THEY chose not to go. They do not need lawyers, politicians or law enforcement to make their decisions for them. We aren’t talking about a place that hands out cigarettes and condoms to their young visitors. They provide fun games for children to play. The kids aren’t sitting there thinking about their odds of winning or trying to “count cards”. They are having FUN with other kids. They win, awesome! They lose? Time to go to another fun, loud, colorful game. Big deal.

    I could understand comparing this to slot machines if the kids were collecting money from it in return! However, all kids like getting rewards for fun and for good behavior. Why is this so wrong after all these years that they have been in business? People will file a lawsuit for next to nothing! It is a sad thing to see!

    So, are they now saying that kids can’t play any games for prizes? If that is the case, you have to close down Dave and Busters and other places like them because they have the same kind of games that give the kids tickets to collect for prizes. My kids are all in their 30′s now and it didn’t hurt them when they were kids and all of them once lived in Las Vegas and actually never spent time in the casinos! They are not gamblers! They held down good jobs and paid their bills just like million of others that live in the state of Nevada where gambling is legal!! In the end, it is a personal choice to play for fun or for real money when the kids grow up!

There is no mention of a lawyer’s statement, I can’t imagine any lawyer, ANY lawyer, taking this case since their fee is based on the money rec’d if winning class action’s, not based on a set fee…usually. As for as the mom is concerned, I can imagine her sitting at one of the tables wondering how she could get money and 15 minutes of fame.

    Don’t know about filing a lawsuit but I think that mom’s got it right. I mean really what’s the difference about adults going to casinos putting their money in the slot machienes and getting a slip of paper to turn in for cash (if you’re lucky enough to win something). Plus the overload on lights and noise. Really it’s like a kiddie casino only the parents are paying for it. Personally I think these places ought to be sued for beeing overpriced, a lot of money for a little value. Whatever happened to a good old birthdayparty at home??
    Don’t neccessarily agree with the lawsuit but I think she makes a point long overdue.

    It’s one thing to make a commentary but something entirely different to SUE. If they are over priced, don’t offer the entertainment you value as a parent, are too flashy, etc then stay at home or go somewhere else that fits your needs. If she wanted to make some sort of commentary then get a group of soccer mom friends and picket/boycott the place. What ever happened to protesting and getting the attention of the law makers instead of trying to BE a lawmaker? That is why we voted. Make them to their jobs!

    I’m sorry, why does Chuck E Cheese deserve soccer mom protests and the attention of law makers? You don’t like the services offered at a particular business, simply don’t go.

    @Susie – I’m not saying that they deserve it. I completely agree if you don’t like a business you shouldn’t go. However, there are results that come from picketing and boycotting something. This is probably not the case but much better than spending tax payer’s dollars on a lawsuit!

    Technically its true all of Chuck E Cheese’s machines that award tickets are illegal under California State Law. I’m all for these machines being legal for selfish reasons. In my local Chuck E. Cheese they have coin pushers so I think I should be able to have a coin pusher in my place of business as a source of extra income.
