Fight Over New DNA Evidence Delays Teen Lovers Murder Trial

PLACERVILLE (CBS13) - Tylar Witt had been expected to take the stand this morning in the case of her mother's death and testify against her boyfriend but the trial was abruptly postponed apparently over new DNA evidence.

Witt's boyfriend Steven Colver is on trial for killing 47-year old Joanne Witt in June 2009. Tylar, who was 14 at the time, has already pleaded guilty in the case and is going to testify against Colver for a reduced sentence.

However, just minutes after Tylar Witt entered the courtroom this morning to take the stand, she was abruptly removed from court and the judge postponed the trial until Tuesday.

A court clerk tells CBS13 the delay is due to new DNA evidence. Attorneys in the case are arguing over whether this new DNA evidence can be used in the trial.

Those arguments will be heard on Tuesday.

The defense is trying to prove Colver confessed to killing Joanne to protect Tylar who they claim actually killed her mother.
