California Lawmakers Advance Bill To End Death Penalty

 SACRAMENTO, Calif. (AP) — A bill that seeks to abolish California’s death penalty has advanced after its first legislative hearing.

   The Assembly Public Safety Committee voted 5-2 Thursday in favor of SB490 after hearing testimony from the author of California’s death penalty law and a former warden who presided over executions. Both now believe the state should end capital punishment.

   They cited a recent study that found California has spent $4 billion on capital punishment since it was reinstated in 1978 but has executed just 13 inmates during that time.

   California has the nation’s largest death row, with 714 inmates. Most are more likely to die of old age than lethal injection.

   If signed into law, the bill would put the question before voters in 2012. It now goes to the Assembly Appropriations Committee.

    I support the Death Penalty, and agree that the appeals process needs to be streamlined, however it’s important to preserve safeguards to prevent irreversible miscarriages of justice. We need to be sure beyond a shadow of a doubt that a person deserves to die before we put them to Death. This could be better ensured by make the Death Penalty only available on cases where there is real, hard, physical evidence that a person committed the crime in question.

    I know I might be impugning an easy scapegoat, but the reason capital punishment has been rendered ineffective is the media.

    Many people believe the reason Casey Anthony “got off” in Florida was that legal “analysts” like Nancy Grace and Marcia Clark tainted the jury pool and therefore, ruined her chance for a “fair” trail.

    I’ve heard that in many Eastern European and Asian nations, they shoot their defendants immediately after their convicted. But then again, these nations’ defense attorneys, prosecutors, and judges, earn a small fraction of what people in these jobs would make here in the US. They don’t write books, work for Fox, CNN, nor MSNBC, nor appear on Letterman.

    I remember a case in a Federal Court where a terrorist was found guilty. The judge could’ve sentenced him to death, but chose not to. She did want him
    to gain “martyr” status and encourage more of his followers to do the same.
    Her message: I don’t think you deserve to live, but you’re not using my courtroom to make a spectacle of yourself, you’ can do that in prison.

    Many people question the ethics of the “slime-ball” defense attorneys, but there are also many cases where a prosecutor knew someone was innocent, but
    wanted an indigent defendant for a “slam dunk” victory and media gain.

They proably know that the public lynching squad is setting their sights on them and they don’t want to hang for their crimes either. You know that coming up on the Labor Day Weekend we are having a little celebration about the Gold Rush Days. This would be a perfect time to celebrate our Freediom from laboring for their likes. The legislature doesn’t support us and I am sick and tired of supporting them and their minions. There will be lots of horses, rope and there are plenty of trees in Caiptol Park.

    They were found guilty let them pay their due…they didn’t give their victims a second thought..but our good congressmen are going to let them live so the tax payers can keep supporting the gulity.

    You know that with Brown in office that he will try his best to abolish the death
    penalty, as Lt Govenor he didn’t execute if he could possibly get away with it
    but if they do would they make it mandatory coverted to life sentence or would
    they make them eligble for parole. If they do abolish death sentence I think they should make one prison strictly for lifers and have it a maximum where
    there is no TV, no gym, and only out 1or 2 hours a day, make it a punishment
    for taking someones life, now prisoners have more benefits than the poor in
    our state, makes you wonder.

    The bleeding heart liberals have distroyed California. The voters have sanctioned the death penalty several times but the liberals don’t listen. This state is broke and these idiots want to continue to spend money we don’t have. Streamline the appeals process….If convicted, one appeal within 6 mos then exicute the sentance if found guilty. We would save billions. If I were wrongly convicted of a crime that carried a life without paroll sentence I would rather be put to sleep!
    We need to kick “illeagles” off welfare and medicade/medicare too. No free college for them either. It’s time to get serious and take our country back and get rid of these idiot liberals that have ruined this stat/country.

    James, I mean uneducated bigot…. the people in a state can’t simply vote to trump the Constitution in this case. If California voters passed a law saying that black people couldn’t get married, then it should get overturned because it violates the US Constitution. California is part of a Federal Constitutional Republic where ALL people are created equal, not just white people and not just straight people.

    The fact that you can’t understand this speaks volumes as to your intelligence (or more apropos lack thereof).

    interesting considering I am a liberal and approve the death penalty. I guess religious groups who are considered conservatives usually disapprove of the death penalty are now considered liberals (I could name many of you wish)? Dont make stupid statements without having your facts straight.

    As for your “concept” of them only getting 6 months to appeal, it just goes to show your lack of understanding of how long it may take for evidence to arise. DNA and other items have shown up years later that have proven innocent inmates not guilty who were wrongfully convicted.

    By your “brilliant” plan, those people would be dead instead of being set free.

    If people want to set a time limit for appeals, I’m fine with that, but it needs to be years, not months.

    Speaking as what the christian/rightwing nutjobs would likely call a “liberal” (meaning anyone who doesn’t agree with them). I strongly believe in the death penalty. How we’ve implemented it blows. Let’s get those executions rolling folks. Quit spending millions on death row inmates. Find something to do a DNA test on, prove it’s them and give ‘me the needle. Hell, it’s not as though we’re shooting or hanging them, we’d be putting them down like the dogs they are.

    The above was found via a quick Google search. This man is one of 138 people who have been exonerated from Death Row since 1973.

    Thus, for many of the people here who just want to rush to kill everyone with their simpleton lynch mob mentality, it is for all intents and purposes the SAME THING as walking up behind 138 random innocent people in a church, mall, football game, movie theater, etc and killing all of them. Yet no one seems to be able to grasp this basic concept.

    The man in the article (who I hadn’t heard of before this search) spent 1/3 of his life in prison for something that he did NOT do…. over 17 years of his life gone. What amount of money could make up for that lost time and the PTSD, mental and physical abuse he faced in prison? Well, they gave him $100, a shirt, a pair of pants and still to this day haven’t apologized to him.

    And why did he get convicted? Because some guy had a grudge against him and falsified his testimony. That could happen to ANYONE here.

    Additionally Shelly, if you are interested (or anyone else here who wants to hear a different perspective), this is a solid piece on the Death Penalty issue. I personally don’t necessarily agree 100% with everything in this episode, but it does give a nice 360 degree view of the topic.

    In the video, here are a few of the items that are covered:

    – They cover the execution of Stanley “Tookie” Williams here in California (co-founded the Crips in California).

    – They have on Marc Klass, father of Poly Klass who is pro-death penalty. Richard Allen Davis (as$hole extraordinaire) is still on Death Row here in California.

    – They have on Alan Gell who was sentenced to death row when the DA had INTENTIONALLY withheld evidence that proved he was innocent. We think of these DA’s as being good people who do the “right” thing, but often they are more concerned with their conviction rate than actual justice.

    We should lower the standard of living for the inmates on deathe row (and all other prisoners). Criminals should not live like royality, at best they should live at the poverty level and they should have to earn the right to live even at that level

    Why do we have to feed 700 & some inmates with our tax money? Do you think they didn’t cause their victims PAIN when they killed them? We do support the DEATH PENALTY, and the executions should resume. We need to speed up the 3 appeals systems and clean out the prisons. Have most of the prisoners on death row had their 3 appeals? If so GET RID OF THEM.

    All this does is allow killers to kill. It is so sad that as taxpayers we have to support these killers who showed their victims no mercy and they don’t get appeals since they are already dead. They are treated better than the homeless and those working who can’t pay the bills since they get a roof over their heads, get health care that many law abiding citizens can’t get. Why should we allow this? As far as the cost, the justice system should let someone of the victims family do the honors and put a .45 bullet in the head of their killers heads. A box of shell is about $20 dollars. Nobody has the right to take the life of another human being unless it is justifyable and those who do should pay the price.

    That’s make a lot of sense, Joe. We need to take each capital case on an individual basis. The last thing we can take from any person is their life. Whether we’re right or wrong, we can’t bring it back.

    We shouldn’t just say that when you troll for tuna, sometimes a dolphin gets caught in the net.

    I’m not saying I’m opposed to capital punishment. I just think it should be meted out for what someone did. Not because of their race, faith (or lack of it), income, education level, sexual lifestyle, friends and family, etc.

    If our judges, lawyers, prosecutors, and especially our journalists would put more emphasis on professional responsibility over politics, agendas, demographics, and especially $$$$$$$$$$$$$$$—–waiting periods after executions probably wouldn’t be as long. Whether we like it or not, the media rules our nation.

    Not sure what difference it makes one way or the other.

    But watch the video and find out. Alan Gell is the guy on the freeze frame there in part 3… so he’s white. The people who testified in court against him were ironically the two people who committed the actual murder.

    If you are referring to the link I provided above with Juan Melendez, I’m assuming he’s has a Hispanic background, but he was born in New York. The guy who held the grudge against Juan was named David Falcon so I have no idea as to his ethnic background.

    People like Richard Allen Davis deserve to be killed. This was a CLEAR cut case. He even led the police to the body. Combine that with ridiculous criminal history that is a mile long and his actions during sentencing (such as saying that Polly’s last words were “Just don’t do me like my dad.” right before he killed her) and this guy has no use for society. This man had his chances over and over and over again. Hell, I’d pull the switch on him myself.

    However, many people’s cases on death row are nowhere near as clear cut as the Davis case. Those are the people that should be allowed their right to due process.

    In all seriousness, you are disgusted because you have not educated yourself on the matter. You fear what you don’t know. It exists all over nature. Other highly intelligent mammals don’t do it be per-verse, but rather because that is what nature dic-tated.

    What if your son turned out to be gay? Would you really be so shallow that you’d disown your own child because you’d be more concerned about peer-pressure from society???     Put them in general population, let the other crimianls take care of them. California can use that money for something way more important than criminals. If you aren’t going to use it, get rid of it, save the money. People like Scott Peterson would have to watch their tail-feathers instead of the tax payers paying millions more a year for the guards to protect him. Waste of money!
