Police Release Kidnapping Suspect For Lack Of Evidence

STOCKTON, Calif. (CBS13) -- The only suspect in the search for a missing woman walked out of jail Wednesday after county authorities said there wasn't enough evidence to press charges against him.

Jason Gilley, 25, traveled back home Wednesday evening after the San Joaquin County District Attorney declined to file criminal charges against him in the disappearance of 23-year-old Dalene Carlson.

Stockton police officers have launched a search of a muddy, low section of the Calaveras River known as a dumping ground in search of the body of Carlson's body, the first sign from authorities that they believe the woman who was reported missing last week could be dead.

Gilley and Carlson were recent acquaintances and were seen together at Finnegan's Bar and Food 4 Less on August 7. Investigators said they arrested Gilley after he gave "inconsistent" statements when questioned by detectives.

After his release, Gilley told CBS13, "It's been a rough few days. I'm trying to recuperate right now. I hope they find her okay."

The search for Carlson in the Calaveras River ended at sunset Wednesday and will resume Thursday morning at first light.
