Calif. Supreme Court To Consider Marijuana Dispensaries

SAN FRANCISCO (AP) — The state’s high court will attempt to clarify marijuana’s hazy legal status in California.

The California Supreme Court on Wednesday voted unanimously to review how cities and counties regulate marijuana dispensaries.

The court will address whether local governments can bar the pot shops despite voter passage of Proposition 215, which legalized marijuana use with a doctor’s recommendation.

The court also will consider the continued conflict between state and federal authorities, who don’t recognize Proposition 215. Under federal law, marijuana is illegal in all forms.

An appellate court last year struck down Long Beach’s attempt to license pot stores, ruling that the local ordinance conflicted with federal law. Another appellate court upheld Riverside’s right to close and prohibit dispensaries.

The Supreme Court has not yet scheduled oral arguments for the cases.

I sure hope they get this settled.

It should be legal in every State.

Marijuana…. It grows, you harvest it and you smoke it or make oils or a gazzillion other things with it… There are so many uses and it help those who really do need some pain control… Or, they need something to make them hungry, because the Cancer has got them so bad that they are losing the battle… There are a number of reasons that this is a good thing….

Don’t make us all get our marijuana from the Cartels…. Flood the States with cheap pot, and put those b/a/s/t/a/r/d/s out of business, once and for all…..

Seriously…. Why would we have to buy from them when we can hold our heads up and walk into a shop and get our meds. and leave without having to look over our shoulders, and doing the deed in dark alley’s…

Flood each and every state with cheap pot….. Use the pot that you have siezed in raids, and make money off of it…. Better the States, & Federal Government get paid, rather than the Cartels…. Hurt them right where it hurts the most….. Right in their pockets…. Take away their Mansions, Cars, Jewels….. Put them out of business in the United States….. Send them back to wherever they came from and deal with it……

If the court wants to be taken seriously then they can only vote one way..!!

And that is simply that cites do have the right to regulate any business including Marijuana dispensary’s. They have the right to regulate Marijuana dispensary’s in the same way they can regulate any legal business such as through zoning laws and so forth. What they don’t have is the right is the right to ban them outright…

Banning a legal business such as a Marijuana dispensary’s would be no different then banning churches, restaurants, bars……….
