UPDATE: Convicted Cop Killer Topete Sentenced To Death

YOLO COUNTY (CBS13) - Convicted cop killer Marco Topete has been formally sentenced to death.

A Yolo County judge formally sentenced Topete to death Tuesday morning for the 2008 shooting of Yolo County Sheriff's Deputy Jose Tony Diaz.

Topete showed no emotion during the sentencing.

Diaz's family members addressed Topete directly during impact statements Tuesday and called him a coward.

"It took a lot to stand there, but I was thinking of Tony, of being there for him and knowing that he would want me to stand up and to look at his killer face to face and let him know that he took from me," said Lupe Diaz, Tony's sister.

Last October, jurors found Topete guilty of first-degree murder and recommended the death penalty.

During the trial, prosecutors argued that Topete was a gang member who hated police, and that during a high-speed chase he lured Diaz to a secluded rural road and fire 17 shots at him in an ambush-style attack.

The defense hoped jurors would believe their claim that Topete was under a high amount of stress at the time and suffering from ADHD. Topete's attorney said he will appeal.
