Sex Offender Not Appearing On Megan's Law Due To Loophole

WOODLAND (CBS13) - After being convicted of sex crimes, Mark Anderson was released from state prison on April 25. However, his picture doesn't appear on the Megan's Law website, and it won't.

Tanya McKay is one of the victims of former Woodland dentist Anderson.

He fondled her breasts while she laid in the dental chair.

"For him to do that, it was just so violating as far as my trust," said McKay.

He was convicted and sentenced to six years behind bars, but now he's out.

According to Sacramento County Probation, he is registered as a sex offender but his picture will never be on the Megan's Law website for the crimes he committed.

The Attorney General's Office says Anderson is one of more than 12,000 sex offenders in the state who aren't required to be on the site.

That's because he was convicted of several counts of sexual battery, which is one of several sex crimes excluded from Megan's Law.

"That comes as a shock to me. There shouldn't be any exemptions," said McKay. "If you are a sex offender then you are on Megan's Law period."

So while Anderson will always have to register as a sex offender, only law enforcement will know where he's living.

It's a legal loophole that's left many of Anderson's victims feeling violated once again.

"It's kind of dumb founding," said McKay. "Our laws are there to protect us and if they're not doing that, then there needs to be some changes."

CBS13 asked the Attorney General's Office for a list of the types of sex offenses that don't require a person's picture to be posted but have not yet received a response.
