Call Kurtis: The Bank May Repossess the Car My Dad Left Me

SACRAMENTO (CBS13) — Still grieving for their father, sisters Lisa Sanchez and Theresa Luna say they're fighting Wells Fargo to keep a car he willed to Lisa. In his will, he clearly states he wants this uniquely colored green Jeep he bought a year ago to go to Lisa who cares for her 91-year-old grandmother. It's the only car she has to shuttle her to doctor's appointments.

"This is our only means of transportation," she said.

The car's payments to Wells Fargo are up to date and were always paid on time. Lisa says when she informed the bank her dad died they said she's not allowed to make payments.

"It's not my loan and I'm not allowed to keep making payments on the car," she said. "They said they would repo the car."

"It's so unfair to think that when you're in a time of crisis, they don't have compassion," Theresa said.

Attorney Jeff Klink calls the situation perplexing saying Wells Fargo should be concerned about the car if they have reason to think it's uninsured or won't be paid off. Lisa says it is insurance and has every intention of making payments.

"If Wells Fargo doesn't want to receive payment on a debt owed to Wells Fargo, then I don't understand why they entered into a contract in the first place," Klink said.

We reached out to Wells Fargo and right away they agreed to put the car in Lisa's name. They couldn't explain what happened here or elaborate on their policy but said in a statement, "We comply with the laws of the applicable state and attempt within the constraints of that law to assist those claiming a right by heirship."

It's a victory for these sisters who know their dad would've wanted them to fight for his car.
