Good Samaritan Sued For Parking Van On El Dorado County Street, Just Like His Neighbors Do

EL DORADO COUNTY (CBS13) — A Cameron Park man says he's being sued for parking his van on the street outside his home.

Richard Kirk has parked his van in the spot in front of his home for more than a year now, something his neighbors also do. But now he's being sued and he's being unfairly targeted by the Cameron Park Community District.

Kirk uses the van to feed the homeless in Sacramento, and says there's never been a crackdown on parking until now.

He knows the van isn't pretty, but it does the job in his church community outreach feeding the homeless.

"We load up about 250 sacks that our congregation has made and we take them down to the Richards Boulevard area," he said.

Kirk got served with the lawsuit last week, along with a copy of his covenants, conditions and restrictions—rules which many neighborhoods have.

The complaint against him was over his van, parked in the street.

"The van is not broken down; the van is not spilling oil," he said. "I really don't understand it, I really don't."

He says he's lived there for 12 years, and the parking rules have never been enforced.

The rules state: "No such vehicle owned or in the possession or under the control of any resident in said subdivision shall be parked overnight in any street within said subdivision.

Neighbors CBS13 spoke to say they have never received a warning, despite regularly parking on the street themselves.

Kirk says he will comply.

"People in this neighborhood know that the van is for the homeless so i don't understand while they're targeting it other than the looks of the van," he said.

Kirk will get a mediation hearing in December, and now that he's moved his van, he hopes the whole thing goes away.

CBS13 reached out to the Cameron Park Community Services District, who did not respond to our questions about their enforcement in this case.
