Arrest Made In Cold Case Murder Of Modesto Woman

MODESTO (CBS13) - A cold case cracked after 13 years. Investigators believe they know who killed Lacy Ferguson, news her mother thought would never come.

"I don't know how I will react when I see him. I've waited for this moment for a long time," said Boni Driskill, Lacy's mother.

For the first time in nearly 13 years, Driskill will come face to face with 44-year-old David Aguilar, the man suspected of killing her daughter. It's a familiar name.

"I had heard it off and on through the years, but I didn't know the person," she said.

Investigators believe Lacy Ferguson didn't know him either. On August 24 2003, Lacy was on a date with her boyfriend John Ritchie and stopped in at a local convenient store. Police say a car pulled up and fired multiple rounds hitting the two, and a third victim. Investigators believe the bullets were intended for someone else and was gang related.

Lacy died the next day, the same day her daughter Haley turned three.

"It's been very difficult for us. It's been very difficult for Haley, not having a mother. It's definitely been very difficult for me not having a daughter. I think about her every day and miss her tremendously," she said.

Driskill held vigils and tried to remain hopeful, but feared the day would never come.

But it did and it turns out, the alleged killer has been in a Mexican prison since 2014. Detectives opened the cold case and after a year, collected enough evidence to charge Aguilar with murder. He was picked up in Mexico and put in prison. He was then extradited to Stanislaus County where he awaits trial.

"We fought so hard to get to this day and now that the days here, for me it feels like this is the beginning of part two because I know that I will have to go through the trials and tribulations of the trial and whatever else. I wish it would all just end," Driskill said.

John Ritchie, Lacy's boyfriend, died a few years ago. Her mother tells CBS13 it was from a broken heart.

Aguilar will be arraigned Tuesday, both Boni and Hayley plan to be there.
