Off-Duty NYC Cop Accused In DUI Crash That Killed Calif. Student Fired

NEW YORK (AP) - An off-duty New York City police officer arrested on manslaughter and driving-while-intoxicated charges after a crash that killed a college student has been fired.

Police Commissioner William Bratton announced Nicholas Batka's firing Wednesday.

Batka previously had been suspended. His lawyer says the firing wasn't a surprise.

Attorney Michael Farkas calls the case "a terrible tragedy for all concerned" and says he and Batka will work to bring all the facts to light.

The SUV crash Saturday in Brooklyn killed 21-year-old pedestrian Andrew Esquivel and seriously injured three of his friends.

Esquivel came from Healdsburg, California. He attended the Massachusetts Institute of Technology and was interning in New York.

Two other off-duty officers who were with Batka have been stripped of their guns and shields while an investigation continues.
