Kids At Lodi Skate Park Help Capture Rape Suspect

LODI (CBS13) -- A group of kids at a Lodi skate park helped police capture a rape suspect, according to Lodi police.

The juveniles were at Kofu Skate Park on Sunday evening when they witnessed an adult man go into the restroom with a 13-year-old girl from their school, according to police.

One of the kids, Nick Burry, says 26-year-old Donald Bush spent about 25 minutes locked in a bathroom stall Sunday with a 13-year-old girl and the two were having sex…

"We went there and told him, 'You need to get out. The girl's 13, and you're 26,'" Burry said. "We saw them walk out and I said dude, that girl does not look over 15 tops."

Some of the kids at the skate park noticed the 13-year-old was actually their middle school classmate. A crowd of about 25 young teens surrounded Bush, Burry said.

"Everyone wanted to beat (him) up, but that always runs back on you, so we kind of just dealt with it, then we ran him off to the hospital," Burry said.

Bush then fled on his bike and the kids chased him, ending up in the lobby of Lodi Memorial Hospital. Hospital officials called police.

Police arrested Bush on charges of sex with a minor under the age of 16, lewd acts on a minor, annoying and molesting a minor, burglary and contributing to the delinquency of a minor.

"It was obviously a good thing," said Detective Eric Bradley of the Lodi Police Department. "They did the right thing."

"There was some indication that they were consuming some alcohol and maybe smoking some marijuana, and at that point they were probably both under the influence," Bradley said.

The kids say Bush is not part of their crowd, but they've seen him hanging out at the park this summer drinking and smoking.

"There's a bunch of creeps everywhere you go, but we try to keep it nice over here," Burry said.
