Jaycee Dugard Breaks Silence, Campaigns Against California's Proposition 57

EL DORADO COUNTY - It's a case that's hard to forget, an 11-year-old South Lake Tahoe girl was kidnapped and held hostage for 18 years, but now she is taking to Facebook to stop a proposition on the November ballots.

"The eligibility for parole for Philip Garrido after only 17 years is really a travesty," said James Clinchard, then prosecutor in the Jaycee Dugard case

He believes criminals like Garrido should be locked up forever.

"I can't imagine how she would feel if the Garrido's we're eligible for parole at a date before 431 years," he said.

That's how many years Garrido was sentenced to, but Clinchard said with Prop. 57 Garrido could get that hearing after just 17 years.

Jaycee took to social media stating "survivors like me should not have to worry when and if their rapist and/or their captor will get out."

"It is a very powerful message. It's Jaycee's voice and it's a powerful voice against Proposition 57," Clinchard said.

Phillip and his wife Nancy kidnapped Jaycee in 1991 on her way to school.

For 18 years she was held prisoner and repeatedly raped.

But in 1976, Phillip Garrido was convicted in the rape and kidnapping of a woman in Nevada. Had he been serving his 50 year sentence, he wouldn't have been free to kidnap Jaycee.

"It puts their release in the hands of parole boards, parole boards that were responsible for releasing Philip Garrido after only 11 years," Clinchard said.

But supporters of Propostion 57, like Governor Jerry Brown in a statement said:

"The opposition is either misinformed or deliberately trying to scare voters with falsehoods. The fact is, sex offenders will be absolutely ineligible for parole under Prop 57.

Only very carefully screened non-violent offenders who have completed their primary sentence will be allowed to apply for parole before a board of retired law enforcement professionals who will reject the parole of anyone who is a risk to public safety.

This will allow the state to focus prison spending on keeping dangerous inmates locked up and prevent a court order to arbitrarily release prisoners."

But Clinchard said rape under the penal code is a non violent offense.

In turn, Jaycee states "criminals who do these despicable acts are often masterminds about how to work the system. Please vote no on Prop 57!"

While Garrido will likely never get out of prison, Clinchard wants to make sure victims like Jaycee never have to relive the torture through repeated hearings.
