Stockton Homeowner Wants Police To Fix Trashed House

STOCKTON (CBS13) — The San Jose Police Department stormed into a Stockton home searching for an accused killer, but they left without him, and left behind a complete mess.

“I feel like a war was taken on here, and we lost,” homeowner Joann Rice told CBS13.

Almost all of the windows are smashed in, there are holes in the wall, and there’s a layer of tear gas in the air so thick breathing it in makes you cough.

That is the home Rice came back to after the San Jose police held a fruitless 12-hour search on Saturday for Steve Ruiz, the man accused of killing a Hells Angels member at a funeral.

“He wasn’t here, he was never here and he wasn’t in the house,” she said.

Rice said her daughter was an acquaintance of Ruiz, nothing more.

“When she opened the house at 7 in the morning she asked them to come in, all they kept saying is, ‘Are you in danger? Are you in danger for your life?’ She kept saying, ‘No, my kids are in here, you can come in here if you like,’” Rice said.

Rice says police didn’t listen. They grabbed her daughter and threw her in a police car for four hours and then into a jail cell.

While police shot tear gas into the home, a mother dog and her three puppies were still inside the house.

“They told her if there was anything left in that house, it’s dead,” she said. “We were hysterical and thought the puppies were dead, the other dog was dead.”

The dogs, fortunately, are in good condition. The house isn’t.

CBS13 made several calls to the San Jose Police Department, but didn’t get a call back.

“We want it fixed,” Rice said. “Of course I’m calling my insurance, but San Jose has to pay for this, there is no reason why they shouldn’t.”

Rice said the family doesn’t know if they’ll ever be able to live in the house again.

    There was no imminent threat, no one being held hostage, no gunfire, no shouting, nothing that would warrant the police terrorizing those people and busting up their home as the cops did. The police arrived, appearing calm, but when the girl politely allowed them inside, they went berserk.

    While people sit hypnotized in front of the TV, I’m seeing many signs of a police-state rising in our midst.

    The CA police is the worst – every county – the worst in the nation. There are few words to describe their BS, they will attack you if they don’t like you, if you have a complaint – you had better be the same race as the officer showing up.     The San Jose Police Department must pay for the damage and add another $50,000 of added value in improvements to this family’s home, a home which they purposely trashed in total disregard for community decency. This is MINIMUM!

    The only question should be whether all San Jose Police Dept members must pay or only these criminals who destroyed this family’s home and killed at least one dog.

    The police commissioner and the mayor of San Jose could also pay out of their personal money. Not one penny of public money can be spent. It must ALL come from these policemen’s personal money. They can take a mortgage out on one or two of their houses. They can take it out of their retirement funds, or their personal savings, or their children’s college funds, but not one penny can come from the taxpayers’ monies.

    With or without a search warrant, a search must be conducted in a reasonable manner by police. Breaking windows when they are already inside the house is clearly unreasonable. The victim home owner should sue the police for trespass and malicious destruction of property in that the police exceeded the scope of her consent and acted in a hostile and outrageous manner.

    Regarding the Patriot Act, another thing is VERY clear. Bush wanted it with the intention of monitoring calls originating OUTSIDE the nation and being made to suspected terrorists. The marxists screamed bloody murder over THAT, but it took them NO time at all to “expand” the act. This is always a major problem when enacting legislation. You MUST be aware of what the marxists will do with it when they are in the majority. If there is any way to abuse it, THEY will find it…..

    Next time you watch a TV crime program where SWAT teams bash down doors and go in armed to the teeth and pointing weapons, where there is no evidence of immediate danger (or even evidence that an armed suspect is in the house) remember this story. Americans are being desensitized into think that the militarization/thuggery of our police is OK and “normal”. It ain’t.

    I’m conservative, support our troops and believe in small government. I also own weapons and believe in the 2nd Amendment. But, cops have been put on a pedestal ever since 9/11 and I for one, have come to the conclusion that they are out of control, have total power and are trampling on the rights of citizens everywhere. This is why we have a 2nd Amendment and it may happen in my lifetime that people get fed up enough to fight back. Cops are totally out of control and it’s time to put an end to it.

    You are exactly right. We live in an increasing police state. Some of these types of things did happen when George W. Bush was in office, BUT, I am reading more and more accounts of events like these under Barry Soetoro. This woman was seemingly polite and look where it got her! I don’t ever plan to let the police into my car/home or whatever. If they can supply a search warrant, then you should let them in. If not, tough beans.

    This is predominantly a local issue, though feds may be needed if local pd gets too out of hand and the state can’t do anything.

    I saw a house the “Pigs” went through looking for papers.They took a pot of beans that was on the stove and threw them all over the wall, dumped jelly out on the floor and smeared peanut butter all over the kitchen then threw clothes on top of that and walked all over them. They never did find what they were looking for because it wasn’t there . After seeing that, I never again felt bad when one of them got shot.

    This is not an isolated incident. The local PD trashed a house in this area, on the assumption that a notorious cop killer was hiding there. It was his sister’s house. Ironically, she was the one who had alerted the police as to her brother’s intention to kill cops in the first place! The house, which wasn’t in such great condition prior to the police blasting it with tear gas, flash bangs, etc, was rendered unlivable. Net result…the city had to pony up $1imillion in compensation!

    Legally the cops are not liable. It is the new poiice state that is America. If the president does not obey the constutation then why do you expect cops to follow it?     Here in Seattle the police often look like U.S. Army with body armor and digital camo. They’ll smash your skull into a concrete wall if you get on the wrong side of them. One young father is now a vegetable for life after getting slammed into concrete, breaking his neck. As expected, the cop was cleared of wrong doing and probably promoted by now. I think about that man and his near orphaned baby girl often.

    One thing I don’t understand. Why are San Jose Police breaking into a home in Stockton. Isn’t Stockton 60 or so miles away from San Jose? Wouldn’t Stockton Police be asked to do the raid.

    I never heard of police from one town doing an operation like this unless it was an immediate emergency in an immediately neighboring town.

    I can relate. The same thing happened to me. My 10 year old son and I got arrested for shooting off Estes model rockets. The police were “alarmed” because they got a tip I had bought “salt peter” to make the rocket motors and because of 911 equated that to possible terrorism. They ransacked my house so bad it took over a month to straighten it out. They moved furniture from upstairs to downstairs & vice-versa & broke a bunch of it. They stacked everything I owned (which is a lot of stuff) into huge piles up to the ceiling, breaking so many things I lost count. Even though I gave them the keys to everything, and combinations to the safes, they destroyed the shed door ($500), Used a brand new axe that I had not even unwrapped and destroyed one safe (and the axe). Holes in the wall. Kitchen utensils, pens, scissors, and other objects were planted in my garden and in hanging plants all over the house and outside. It was so obvious that these goons were having fun breaking stuff on purpose. I swear, if I had paid ten Hell’s Angels to spend an hour destroying my house I would have ended up with the same result. BTW, $10,000.00 was stolen from one safe, thankfully they left my gold coins behind.

    I used to respect the police, not anymore. I am a volunteer firefighter too, I thought I would get treated a little better for that. Heck, maybe I did. The police have really changed since I was young. They really have become a hit squad. One police officer I know as a friend told me he will arrest anyone he can for any reason he can conjure; he said it provides him with job security by getting people pulled into “The System”. This is really F’d up thinking and is not the same country I was born and raised in.

I fingered the perp but she let the perp walk because it was too much work for her. Trashing this ladies house was is the lazy way to do business, real cops would have simply asked the right questions to get what they were looking for.

    A “search warrant”, as you put it in quotes, is not required when it is impractical to obtain one because of time constraints, e.g., hot pursuit.

    The way out of this problem is simple: the city or whoever employs the police here pays to fix the house. Failing that, I never knew what the law was re liability for proper police action. (If the police acted improperly, e.g., no probable cause, that might give rise to a valid lawsuit for violation of civil rights.)

    The militarization of the police began long before President Obama or President Bush. At a guess, the rationale began with the “War on Drugs” during the Nixon administration. If you go back and look at old movies, like the Dirty Harry series, or the Steve McQueen movie Bullitt, you don’t see the military uniforms or military style weapons or the SWAT tactics.
    In today’s movies, nobody knocks on a door and serves a search warrant. It is all militarized, with fully armored thugs doing dynamic entry, breaking down doors and entering with automatic weapons. What used to be the rare exception is now the norm.

    Why isn’t anyone asking why the San Jose Police are in the Stockton jurisdiction? Those are two different cities, separated by at least 70 miles. The Stockton jurisdiction has the police force to perform a search; I fail to see why SJPD is doing this! I would have told SJPD to ‘F’ off.

    Moreover, when you let the cops in your house WITHOUT a warrant, you are asking for trouble. And just because they say they are looking for someone they still have to get a warrant! Oh yes, the cops will lie like hell to get access to your house. They have to, because they dare not kick the door without a warrant because they will be violating at least a dozen Federal and state laws themselves, and they can’t hide that.

    One may ask, why the arrest of the woman? More than likely, they may have found some weed or something to jail her for.

    LISTEN PEOPLE: If you give consent for search, and they find contraband, they can arrest you!! It is the same as a confession! It doesn’t matter if it is a car or a house, DO NOT CONSENT, no matter how many times they bully you with threats of arrest or verbal tactics that you must be guilty of something or trying to hide something! DON’T DO IT! Look up search consent on YOUTUBE!

    And when the cops show up, SHUT YOUR MOUTH, AND KEEP IT SHUT.

    Nonetheless, if they didn’t have any evidence, then at minimum, a false arrest and property damages law suit is in order.

    This is a variation of the broken window fallacy. I detected the sarcasm, but people actually believe this line of logic, so I thought I’d explain why it’s wrong. It can be easily exploded by asking yourself this question: Why is it considered beneficial to have to spend a lot of money to end up with the same things you already had to start with? Wouldn’t it be better for everyone if, instead of spending money to replace things you have already purchased in the past, you could spend money on NEW things? For example, if you have a window which gets broken, and costs $100 to fix, when the dust settles you will have a window, but you won’t have the $100. Well, you had the window before, AND you had the $100. Now, you can’t spend that $100 on a night at the strip club or half an NFL game ticket or whatever else you would have spent that $100 on if you didn’t have to spend it replacing a window that you had already purchased in the past. Sorry, I just really hate that stupid fallacy.

    This is a pressure tactic used by the police to get the suspect to surrender to them. If you have no place to go and all friends turn you away you surrender. I would think that the police believe that there is a closer relationship than is talked about. Other friends , acquaintances, and relatives may also get houses trashed by police to deprive the suspect of refuge. It is a harsh tactic but in many cases effective.

    Idealistically officer and public safety is of prime concern by law enforcement and to err on caution is acceptable but, in this apparent case, detaining a resident for hours in a locked patrol car while executing unnecessary and reckless damage to property is totally unacceptable.
    I would have no problem as a juror awarding actual and punitive damages. Believe me, judgments are very affective in curbing unacceptable police behavior but, unfortunately legal actions take time so a hopeful resolution will be an internal affairs investigation and a quiet payout from San Jose PD’s budget.
    One Oddity, the headline says Stockton, which is like 90 miles away from San Jose. What were they doing there in Stockton’s jurisdiction? Maybe Stockton should be liable also

    This happened in Baltimore several years ago. Police not only mistakenly trashed a house which they wrongly thought was a drug house, but also killed the couple’s dogs. They terrorized an old lady who had been in the kitchen baking when they barged in. They are still fighting not only for compensation, but for the police to even admit they made a mistake. Statistically, withing a 1 block radius, you will almost always have an attorney under a bush or rock.     Near Charleston WV the city police recently destroyed a house and it’s contents while looking for evidence for a serious crime that happened several years ago.
    Someone told the cops that what they were seeking was buried underneath the house. The house was actually two trailers bolted together with a common roof. They could have had it dismantled and moved, but instead they hired a contractor with heavy machinery to completely destroy the house and left it in a pile of rubble. Deputy sheriffs stood guard while this was happening. Instead of asking th lady who owned the house for the combination to a safe in the house the cops ordered the contractor to smash it open. There was nothing of interest in it. A local newspaper finally got pics of the rubble and published them. The cops are silent on this matter, and the sheriff says it’s not his problem. I’m old. When I was a kid in the 1940s we were taught that the police were here to protect u and they could do no wrong. After a recent encounter with them, now I don’t trust them at all.

    The police overstepped their lawful authority. The police involved who said the dogs were dead should be fired and prosecuted. Every police person involved should be disciplined. The officer in charge should be fired and prosecuted. All damages should be paid. I hope the home occupant(s) sue the police department, municipality and each officer in tort.

    Judges enable the thuggery and abuse of police. They hide behind judicial immunity. But I believe there needs to be severe sanctions and removal of judges who offer broad sweeping warrants on the basis of a general affidavit.

    The famous quote from the film “Touch of Evil,” by the Charlton Heston character rings true today: “POLICE WORK IS ONLY EASY IN A POLICE STATE.” Making police work harder means we protect ourselves from a “police state.”

    I can just envision arrogant, overpaid, bullying cops harassing and abusing these people and their privacy. Holding police to account as I mentioned will ultimately protect us all.

    Bad intel and no knock warrants cost lives. The police only seem to be upset if a search costs police lives and I understand they have a very dangerous job. But I’ve read enough news stories about people and animals being killed by cops at the wrong address to know that this has to stop. If police burst into a house and a dog barks at them (and 99% of dogs would bark at intruders screaming and storming the place) they shoot the dogs even though they are typically wearing full armor and holding riot shields. That is ridiculous. If peper spray works on bears it will work on a dog.

    If a cop is told, “Oh, ask this person, they might know” even if they don’t, you will get a visit. Its like kindergarten.

    She said that she told the police that they could enter her home. This is what happens when you don’t know your rights. I am sure that the police would have done this anyways, but at least she would have had significant legal recourse had she refused to allow them entry, and denied them the right to search. They dont need a search warrant if you tell them that they can enter your residence.Remember, you have the right to deny consent to search.     I saw the version of this which denies right to bear arms when I lived in GA. The story which happened in my townhouse row to the people three doors over from me goes exactly like this. 1 police execute a no-knock warrant to the wrong house. 2 the police have chosen an arab exchange student who is asleep in his upstairs bed when they smash his front door in and rush up stairs in armor carrying assault rifles with small flashlights mounted to the barrels. 3 the student fearing that he is being kidnapped gets his gun to protect himself from the assault just as the black clad men with automatic rifles reach the top of the stairs and point machin guns at him while he is still on his bed. Now this scenario played out safely that time and the fellow chose not to shoot at the police as would have been his right and he is still alive today, but can you say you expect the same will happen every time? The warrant while legally issued was not issued for him or for his home. The door of my townhouse had been replaced with a steel one when I moved in because an earlier tenant had received a late night visit which had also not been for their address. Now I don’t know who the jackhole was at the Valdosta GA police department that thought it was fun to go to the wrong address to serve no-knock warrants but I can tell you that having a weapon and being able to reach that weapon in time are two very different things when a force invades your home while you are asleep. The police who executed that warrant were in danger just like the person they confronted in his home and make no mistake if I had been able to reach my gun in time to setup for such an assault there would be a few less overzealous police officers in Valdosta GA the next day. Notice that I say if because I don’t believe I would have had any more luck defending myself against such an assult than that student had. It is why I moved. No one should have to fear the police who should be their defenders coming to get them late in the night. The police are liable for the damage they inflicted and you can get the money by filing for damages but what you cannot gert back is the feeling of safety forever gone after the shock of seeing your supposed defenders rabbidly trying to detain you for no crime whatsoever.

No warrant no enter… I doubt a judge would have issued the warrant with the daughter being an acquaintance. 2nd When the daughter is hauled off and held – she is under arrest… Assuming such, she needs an attorney present.     Actually it is the daughter’s fault for letting the cops on the premises without a search warrant and her attorney present. Cops are going to take advantage as there is no risk for them to do whatever they want after being allowed on the premises without a warrant that states exactly what they may search for and who they may detain. Not that I don’t have sympathy for the homeowner, I do. But they were self inflicted victims in this mess. I would get a very good attorney and sue the city unti they bleed. Also I would pursue personal liability suits against the police officers involved as well.

    As a fomer police officer some 30+ years ago, we had a hard time finding good, decent people back then, and it is even worse now. Sadly, I was thinking today if I were called to jury duty, would I believe testimony by any law enforcement officer? Back then we were peace officers. I looked into the bathroom mirror and said silently to myself that I could not trust the word of a LEO without additional evidence that could not be tainted or fabricated. I used to read police reports in the records bureau and there was so much BS in those papers that as a young person I was truly shocked. Police in America cannot be trusted to do what’s right as is evidenced by the actions of these uniformed thugs in San Jose. It seems the only way to combat this sort of thing is to make those who participate in such raids personally financially liable. Why arrest and jail this lady’s daughter? She wasn’t the suspect! Words come to mind that I cannot mention in public. I’m outraged and I hope this family is made whole as best it can by the clowns in state-issued costumes. Shame on them!

    I agree, I remember a time when I could look at an LEO and think he or she was doing an honorable job and was deserving of respect.
    Today I can’t say that or even walk by an LEO with out suspicion.

    We were in New Mexico a few years ago and three different cop gangs came into our house put us out in the snow at 20 degrees it was late at night
    they would not let us have our vehicles the snow had stopped the whole damn town taxis and all. We had two minor children and five dogs to take care of to make a long story short what a bunch of punks they found nothing and left our house trashed the search warrant they were suppose to have appeared the next day. But that was a different story.

    Yet due to their actions police destroy the lives of innocent people everyday and then want us to trust them. The government fails to secure the border, illegal alien criminals have more rights than American citizens. I will NEVER call a cop Yet if you protect yourself you go to jail. What is worse is that I committed a felony 30 yrs ago. Have not been in trouble since. Did all my time and parole yet am still being punished for the crimes I committed when I was 18. I live in a gang infested city but thanks to our glorious laws I am not allowed to own a weapon to defend myself. Thank you America, I’m sure if I had money or was famous things would be different and I would have ALL my rights.

    Last time I saw a follow up one a similar story that’s what they did. The homeowner felt like it would have gone better if they just paid for it themselves. They won there case, got paid 30 cents on the dollar and didn’t seem to change a thing.

    Its a damn shame about what you are having to put up with and not being able to protect yourself.I now carry everywhere that I go no matter what I will NOT become a statistic for no one.It isn’t safe any where these days.More and more people are coming home from work only to run into burgulars ransacking their homes.If I do they will be carrying them out in body bags>Yes they will die with a weapon in their hands.

    Looking at the comments made here- it just makes me sad. There are about 5 people that can make a cogent argument or a statement that doesn’t read like the flailing of a broken mind firing off bumper-sticker politics.

    We are better than that. YOU are better than that. Think. Write. Discuss. Shouting to the world some meaningless babble about thugs or gangs- how is that- anything?

    Dammit people, get yourselves together and be better than this.
