L.A. Man Sues Nintendo Over Donkey Kong Costume

LOS ANGELES (AP) — A man who says he suffered a serious heart condition after wearing a Donkey Kong ape costume at the Los Angeles Zoo has sued Nintendo.

The Los Angeles Times says Parker Mills sued Monday in Los Angeles County Superior Court.

His attorney, Tyler Barnett, says Mills was hired to play the ape character in May for the launch of a Nintendo 3DS game.

Mill claims he was denied breaks while talking to zoo guests and didn't get a required ice pack to cool him.

His lawsuit says a company ambassador hired to escort Mills didn't provide proper oversight.

His attorneys say Mills suffered a tearing of his aortic walls and now has a permanent heart defibrillator.

A call seeking comment from Nintendo representatives wasn't immediately returned.
