Call Kurtis: My New Fridge Destroyed My Food

STOCKTON (CBS13) -- Six months after buying their Samsung fridge, Kristen Morris says it suddenly just stopped working.

"Everything went bad in my fridge," Kristen said.

She said $300 worth of food had to be tossed out.

"I was mad," Kristen said.

After calling Samsung, she said it took three weeks to get the refrigerator fixed.

The warranty covered the repair, but Kristen said Samsung would not cover the cost of the food she lost.

"It violates every consumer expectation that you would have." Attorney Eric Ratinoff said.

Under California's Song-Beverly Consumer Warranty Act, every new appliance sold in the state comes with the guarantee it will work. But, Ratinoff said only the appliance is covered - not what is inside.

"I spent all our grocery money having to eat out," Kristen said.

In a statement, Samsung told CBS13: "Samsung values its customers and is committed to providing the highest quality products and customer service experience. We regret the inconvenience that Ms. Morris experienced. We have followed up with Ms. Morris and are working with her to resolve the matter to her satisfaction. Samsung encourages its customers to follow the instructions in its user manuals and contact 1-800-SAMSUNG with concerns."

After we got involved, the company agreed to pay Kristen $300 for the lost food.

Kristen just hopes her fridge stays on.

"That's all I'm asking for," she said.

According to the Song-Beverly Consumer Warranty Act, if after a reasonable number of attempts a defect isn't fixed, the buyer may return the product for a replacement or refund, minus a reasonable charge for usage.
