Sexually Violent Prisoner May Be Released As Transient After Community Uproar

SOLANO COUNTY (CBS13) A sexually violent predator will be released from a state hospital, and after months of conflict, he may be released as a transient.

Mother of three, Simoni Baltazal is worried about Tuesday's deadline to find a home for Fraisure Smith.

"Why don't they keep him like in a hospital or jail? Why do they have to put him in the streets? It's like, whoa," she said.

It's not a question of if Smith will be getting out of a hospital, but where he'll live. With no solution at the last court hearing, a Solano County judge threatened to set him free as a transient.

"The state shouldn't put this problem on us; they should come up with the solutions," said Jack Conboy.

The state contractor in charge of finding Smith a home and managing his release says 4,108 possibilities in four counties have been examined, and three potential home placements have been blocked by fierce neighborhood opposition.

It's been two year since a judge ruled the sex offender is rehabilitated and ready for reintegration into society.

The Solano County District Attorney's Office says if he's released without a home, he could be placed at hotels and motels and moved every fifth day.

"The solutions they're using—although they may be legal—they're not practical," Conboy said. "This guy's got a lot of problems; mental problems, adjustment problems."

The district attorney's office has opposed the plan to move Smith between hotels, because it could be hard to review each location. The court hearing is set for Tuesday morning.
