Prop. 59: Nothing More Than An Opinion Poll?

SACRAMENTO (CBS13) - Proposition 59 will appear as an "advisory question" on your ballot Nov. 8. It will ask for your opinion and based on the response—will encourage lawmakers to act, but act on what?

The prop would call on elected officials to work on overturning a ruling called "Citizens United versus The Federal Election Commission." It's a ruling that states political spending and contributions were protected as Free Speech under the First Amendment.

We reached out to the non-partisan Legislative Analyst's Office for more of a breakdown. "What this measure will do is ask the voters if California's Elected Officials should use their authority to amend the Constitution in a way that would overturn the Citizens United case," Nick Schroeder from the LAO tells us, "it basically allows the Government to limit spending from people, corporations, unions and any group that wants to spend money to communicate directly to the voters."

The advisory would also "make it clear that corporations should not have the same Constitutional Rights as Human Beings."

So, who's pushing this prop?

Among the national figures lending support: Former presidential candidate Bernie Sanders. Some of the groups supporting Proposition 59: California Common Cause, the California Democratic Party and a group called Democracy for America.

A few major newspapers have come out against this proposition. They call it "nothing more than an opinion poll."
